Mispoke — Terms of Service

Effective date: June 12, 2026

1. Operator

The Mispoke mobile application ("Mispoke", the "App") is operated by Show Your Score Prosta Spółka Akcyjna with its registered office in Warsaw at Aleja Jana Pawła II 27, 00-867 Warsaw, Poland, entered into the National Court Register kept by the District Court for the City of Warsaw in Warsaw under KRS number 0001010337, VAT number PL 5273034354, share capital: PLN 25,000 (the "Operator", "we").

2. What the App is

Mispoke is a language-learning application. You record yourself speaking in a foreign language; the App transcribes your speech, uses artificial intelligence to identify language mistakes, explains them, estimates your speaking level, and creates flashcards with corrected phrases, scheduled for review using a spaced-repetition algorithm. With your separate, explicit consent, the App can create a private synthetic copy of your voice ("voice clone") used solely to read your flashcards to you (see the Privacy Policy).

3. Acceptance and eligibility

By installing and using the App you accept these Terms. You must be at least 16 years old. If you do not accept the Terms, do not use the App.

4. Account

The App creates an anonymous account automatically (no registration, e-mail or password required). The account is tied to your device installation. Deleting the App may result in loss of access to data associated with the anonymous account.

5. License

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes on Apple devices you own or control, in accordance with these Terms and Apple's standard End User License Agreement terms.

6. Subscriptions, trial and payments

1. Selected features of the App require a paid subscription. Current plans, prices and any free-trial terms are presented in the App before purchase.

2. Payments are processed by Apple through your App Store account. We do not receive your payment card details.

3. Subscriptions renew automatically unless cancelled at least 24 hours before the end of the current period. You can manage and cancel your subscription in your App Store account settings (Settings → Apple ID → Subscriptions).

4. If a free trial is offered, any unused portion of the trial is forfeited upon purchasing a subscription, where applicable.

5. Refunds for purchases made through the App Store are handled by Apple under Apple Media Services terms. EU consumers retain their statutory rights; for digital content supplied during the withdrawal period, the consumer acknowledges that starting performance before the lapse of the withdrawal period results in the loss of the right of withdrawal to the extent permitted by law.

7. Fair use and prohibited conduct

1. The App processes audio with third-party AI services, which generates real costs. The App may enforce reasonable usage limits (e.g. maximum recording length and daily recording time), presented in the App.

2. You must not: (a) use the App unlawfully; (b) attempt to clone the voice of any person other than yourself or upload recordings of third parties without their consent; (c) reverse engineer, scrape, resell or abuse the service, bypass usage limits, or extract embedded credentials; (d) use the outputs to create misleading or harmful content.

3. We may suspend or terminate access in case of material breach of these Terms, with consumer rights preserved.

8. Voice clone

Creation of the voice clone requires your explicit consent and is governed by the Privacy Policy. You may only create a clone of your own voice. You can delete the clone at any time in the App settings. We may delete voice clones associated with accounts inactive for an extended period; a clone can be re-created from a new recording.

9. AI-generated content — disclaimer

Transcriptions, mistake analyses, explanations, level estimates and flashcards are generated automatically by AI models. They may occasionally be incomplete or inaccurate. The App is a learning aid and does not replace professional language instruction or certified language assessment. We do not warrant specific learning outcomes.

10. Intellectual property

The App, its design, branding and content (excluding your recordings and your data) are owned by the Operator or its licensors. You retain all rights to your recordings. You grant us the technical license necessary to process your recordings and derived data solely to provide the service, as described in the Privacy Policy.

11. Availability and changes to the service

We strive to keep the App available and may update, change or discontinue features (including for security, legal or technical reasons). Material adverse changes affecting paid features will be communicated in advance where required by law; in such cases you may be entitled to a proportional refund handled via Apple.

12. Liability

1. Nothing in these Terms excludes or limits liability that cannot be excluded under applicable law, including statutory consumer rights and liability for wilful misconduct.

2. To the extent permitted by law, we are not liable for damage resulting from misuse of the App, force majeure, or third-party services beyond our control (including the App Store, network operators and AI providers), nor for indirect damage or lost profits in business use.

3. We are liable to consumers for the conformity of the digital service with the contract under applicable EU and Polish consumer law.

13. Complaints

Complaints can be submitted to contact@mispoke.app. We will respond within 14 days. EU consumers may also use the Online Dispute Resolution platform (https://ec.europa.eu/consumers/odr) and may seek assistance from municipal consumer ombudsmen (in Poland e.g. porady@dlakonsumentow.pl).

14. Governing law

These Terms are governed by Polish law. This choice does not deprive consumers of the protection granted by mandatory provisions of the law of their country of habitual residence. Disputes with consumers are subject to the courts having jurisdiction under generally applicable provisions.

15. Apple-specific terms

These Terms are concluded between you and the Operator, not Apple. Apple has no obligation to provide maintenance or support for the App and is not responsible for addressing any claims relating to the App. Apple is a third-party beneficiary of these Terms and may enforce them against you.

16. Changes to the Terms

We may amend these Terms for valid reasons (legal, technical, organizational, new features). The current version is always available at the address where you are reading this document; material changes will be announced in the App. Continued use after the effective date of changes constitutes acceptance; consumers retain the right to terminate before the changes take effect.
